2. Directory Listings
- Accuracy: Business owners are solely responsible for ensuring that the information provided in their listing (contact details, area of operation, services) is accurate and up-to-date.
- Right to Refuse: BayBiz reserves the right to reject, edit, or remove any listing that we deem inappropriate, misleading, or offensive, at our sole discretion.
- Verification: While we strive to connect users with quality services, BayBiz does not formally vet or guarantee the quality of work provided by the businesses listed. Users are encouraged to perform their own due diligence.
3. Fees and Payments
- Advertising Fees: Fees for featured listings or advertisements are outlined on our Advertise page and are subject to change.
- No Refunds: Once a listing is published or a featured spot is secured, fees are non-refundable.
- Charitable Contribution: You acknowledge that a portion of the profit generated from BayBiz is donated to Miracle Kidz and the False Bay Rugby Club (False Bay Crocs). These donations do not entitle the advertiser to any tax benefits or ownership rights within those organizations.
4. Intellectual Property
- Ownership: All content on this website, including logos, text, and site design, is the property of BayBiz.
- License: By uploading your business logo and description, you grant BayBiz a non-exclusive license to display this content for the purpose of promoting your business within the directory.
5. Privacy and Data (POPIA Compliance)
- Consent: By listing your business, you consent to having your business contact information (Phone, Email, Address) displayed publicly.
- Data Use: BayBiz will not sell your personal data to third parties. We use your information solely for the operation of the directory.
- Security: We take reasonable technical steps to secure the integrity of the website, but we cannot be held liable for unauthorized access to data beyond our control.
6. Limitation of Liability
- "As Is" Service: The directory is provided on an "as is" and "as available" basis.
- Exclusion of Damages: BayBiz, its owners, and its employees shall not be liable for any direct, indirect, or consequential loss or damage arising from your use of the directory or the services provided by any business listed herein. This includes, but is not limited to, loss of profits or business interruptions.
7. Prohibited Conduct
Users and business owners may not:
- Use the directory to distribute spam or unsolicited marketing.
- Attempt to "scrape" or download the database for use in other directories.
- Post content that is defamatory, illegal, or infringes on the rights of others.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the courts in Cape Town.
9. Changes to Terms
